The following describes Dexion’s guarantee of commitment to its customers

In addition to the minimum conditions or warranties expressed or implied by the Trade Practices Act 1974 or other, similar, legislation relating to the sale of products of this kind in Australia, Dexion (Australia) Pty Limited ABN 83 000 083 956 of 23 Tattersall Road, Blacktown, NSW (“Dexion”) provides the following commitment in support of it’s product and services.

·         LIFETIME WARRANTY AGAINTS STRUCTURAL FAILURE

·         LIFETIME WARRANTY AGAINTS DEFECTS IN MATERIALS AND WORKMAN SHIP

Conditions apply – please see below.

  Lifetime warranty against structural failure

o        Dexion warrants that if a Dexion product or part structurally fails during its lifetime then that product or part will be repaired or replaces with a new or equivalent product or part free of charge, subject to the following conditions.

o        This warranty will be void where the product or part has been subjected to application, stress or imposed loadings in excess of that specified by Dexion or misuse, negligence or accident, as Dexion reasonably determines, by parties other than Dexion.           

o        The customer must immediately give written notice to Dexion upon discovery of a suspected structural failure or any other defect in the product part, and allow Dexion access to the place of installation for the purpose of inspecting the product or par and fulfilling its obligations under this warranty.

o        Structural failure for the purposes of this clause 1 means cracking, breaking of collapsing of the product or part.

o        Lifetime the purposes of the clause 1 is defined as twenty years from date of delivery or date of first commercial usage of the product or part, whichever is the earlier.

o        This warranty is not transferable and only applies and is subject to the exclusions set out in clause 4.

  Lifetime warranty against defect in Materials and workmanship

o        Dexion warrants that for the lifetime of its products and parts they will be free from defects in material and workmanship and that any part that, in Dexion’s reasonable opinion, have deteriorated due to defects in materials and/ or workmanship will be replaced or repaired by Dexion without cost to the customer in accordance with these conditions.          

o        For this warranty to remain valid you must allow Dexion to survey your installation during the 12^th month of each consecutive 12-month warranty period, and any parts that, in Dexion’s reasonable opinion, are damaged or have deteriorated due to normal wear and ear or local environmental conditions, must be replaced at the customer’s cost. Failure by the customer to replace those pars identified by Dexion as having deteriorated in this way will void the lifetime warranty.

o        Unless otherwise notified in writing, the Dexion survey in the initial 12 months warranty period will be at no cost to the customer. Dexion surveys in subsequent 12 month warranty periods will be charged to the customer at the rate applicable at the time of he survey ad notified in writing by Dexion.

o        After successful completion of each survey Dexion will issue a certificate of warranty to cover the following 12-month period.

o        Life is defined for the purposes of this clause 13.2 as twenty years from date of delivery or date of first commercial usage, whichever is the earlier.

o        This warranty is no transferable and only applies to new, previously unused Dexion products or pars that have been installed by Dexion and / or its authorized representatives. It does not otherwise apply and is subject to the exclusions set out in clause 13.4.

Products requiring regular maintenance

o        The warranty on he Dexion mechanized equipment with moving parts is conditional upon regular preventive maintenance performed by Dexion service engineers as Dexion reasonably notifies the customer is necessary, and is subject to the exclusions in clause 13.4.

o        The warranty on such products will not apply to their use over 2000 aggregate hours per 12 months period. This equates to a single 8 hours shift for 5 days a week. Where double or triple shift are worked hen the duration of he warranty will reduce proportionately unless other separate arrangements are previously agreed and confirmed in writing by Dexion.

Exclusions

o        This warranty will only apply to new products or parts manufactured by Dexion and will no other wise apply. Dexion will endeavor, but makes no representations or warranty that it will be able, to assign to its customer he benefit of any warranty from the supplier or manufacture of auxiliary products or parts supplied by Dexion, including such items as computer hardware, bar code readers, scanning and other devices, etc.

o        Dexion will not be liable under his warranty for any and all liabilities, claims, damages, losses, costs and expenses of any nature including without limitation loss market, loss of profit, loss of use, loss of production or for any financial or economic loss including indirect or consequential loss or damage which may suffered  by you or any third party arising out of or in any way connected with the supply of the products by Dexion. Resulting from failure of the products (both structural and defects in materials and workmanship), breach of statuary duty or by reason of tort (including but not limited to negligence) except as provided below.

o        Without prejudice to the preceding paragraphs of this warranty the obligations of Dexion under this warranty will be limited to one of the following at the election of Dexion:

§         Repair of the products or

§         Delivery and installation of a replacement product identical or equivalent to the original products.

o        Any Modification, repair or alteration of the products by any third party without Dexion’s prior written approval voids Dexion’s obligations under this warranty.

o        If any products or par is to be removed from an installation, moved to another location and is intended for active service at the new location, the product must be re – certified by Dexion in order to maintain this warranty.

o        Dexion reserves the right to make improvements to its products as to design or materials without incurring any obligations To install or make such improvements to products already supplied.
